HI everyone,
Does any one understand this: Immigration say in order to attain a work permit or a FSW visa, one MUST have a job offer on the required list.
Well in Saskatchewan, I received a job offer for a role that is not specifically on the NOC list but the duties are the same as the NOC list role. I am working in that current role (NOC role) but still was refused the LMO. What exactly are immigration saying/at when they say you NEED a job offer but when you do get one, you dont get accepted!?
Whats the point in trying so darn hard if it keeps happening??
Any advice please or anyone been there?

I don't know what they wrote.
I applied for the FSW visa September 2008 and was rejected in April this year, because I had no job offer. I spent aover €3000 to go back to Canada this summer to search for work, I tried sooo hard with applying for jobs I must have applied for over 100 jobs, managed to get 1 interview and that job was offered to me.
And my employer applied for the LMO for me and Ive been refused again even though i got the job offer they required. Hence "whats the point"!? If I keep trying to please them only to be refused constantly, I am not bothering even though I don#t want to give up'
The 'employer' just said that in the letter from HRSDC they said "Citizenship and Immigraton Canada have refused the LMO for Medical Office Assistant - even though its the same job as the required Medical Secretary - duties wise. So I really can't see me EVER getting a successdul job offer/LMO.
What stage are you at?

Prior to applying LMO, did ur employer publish in any public newspaper about the job vacancy? He should have done that before applying for an LMO to prove that there is no Ca citizen that can fill out the job. You can just follow the job title 2 the NOC to avoid discrepancy. It's their country after all

Oh yes he advertised alright. He'd been advertising since July and i was applying and applying. He interviewed two canadians and gave it to me. I dont know if he could prove it.
I told him so but the job i got was "medical office assistant" Im a medical secretary (duties are same and med secretary is required on the NOC Matrix in Saskatchewan)
So whats the point!? Im not being smart they refused me in April after rules had been published and because Id no job. Then i get a job and they refuse me again.
I heard they are clamping down on foreign applicants for work there at the moment. :(

hi friend sorry for late reply,acording to my knowledge i think that there is no chance for u i know it is very tough time 4 u. but dont lose heart.i want to know that is there any relative or friend of urs in canada if yes then request them to find new job for u bcoz u must have same job title

the title doesn't matter as long as you are performing majority of the main duties of the one in the NOC

Deep17, Why is there no hope for me? Medical Secretarial/Medical Office Assistant are the same job/title/duties and role?! I don't have a relative or friends - its too much hassle for that kind of sponsorship too!
Medcial Secretaries are "Required" in Saskatchewan!
- but immigration consultants are only after your money. They will charge far too much, and you end up at square 1. They dont improve your chances or anything. Bottom line if they say or feel you do not qualify, then they cannot take your case, (but will say we wil get you in if you pay...) I have no faith in them. But thanks for suggestions.
Friends i knw who used this route, were still refused and are still waitng! They probably wont take your case, and cant get you in! Its just bad timing!

Deep 17, Im no longer looking at the FSW visas anymore - SINP is my only chance now, and that still means unfortunately, that I need a job offer - and it must be a 2 year 'permanent' contract. If you get that, processing can be a quick as 4 months and its your PR visa - you can go home and wait and do that, or get a temporary permit while you are waiting, once you have your job and you are in processing...

irisheyes---after 1 year and 5months my application for FSW was denied. My second option is to apply under the temporary work permit as a live-in caregiver, I have an employer and now in the process of getting an LMO.This may be something that you would want to consider,the program/training is for 6 months.
